Why is a Encumbrance Certificate Required?

Encumbrance Certificate Types

ECs come in two different forms. As follows:

If any property has any encumbrance at the time the applicant applied for the certificate, the sub-office registrar issues an encumbrance certificate in Form 15.

If no encumbrance is recorded on any property at the time the applicant applies for the certificate , of the same office with a zero-encumbrance certificate in Form 16 .

What is a Nil Encumbrance Certificate?

If you can send a weight certificate, when your information is required will be your request.

If there is no debt on the property for the said period, a “zero encumbrance certificate” will be issued. This means that none of the debtors had filed a title to the property at that time.

How much does it Cost to Apply for an Encumbrance Certificate?

Each state has a different application fee for a weight certificate. It depends on where the property is located and which state manages it. However, some well-known countries charge the following fees for access to EC.

How to Complete an Online Encumbrance Certificate Application

  • Select the option of applying for EC on the official country website for land title.
  • Complete all required fields in the encumbrance certificate window, then click save/update.
  • Enter when you want to claim EC and select “Calculate Fee”.
  • Once you have paid the required application fee and submitted the application, you will be taken to the “Acknowledgment” window. You can print the receipt by selecting “View Receipt” from the menu.
  • The Superintendent of the Land Records Department shall for a period of time investigate and verify all the details of the conveyed property.
  • Upon completion of the analysis, an EC is generated which includes transactions that took place during the specified period. If there were no cases for the entire period, nil EC will be awarded.

Which States Print Online Encumbrance Certificates?

With few exceptions, ECs are usually actually offered all over India. Andhra Pradesh is one of the states that offer online weight certificates. Other states include Odisha, Kerala, Puducherry, Tamil Nadu and Telangana.

On June 10, 2020, due to technical glitches in the state’s Cauvery online service, the Karnataka government decided to revert to the offline system for issuing load certificates and other title-related documents. The ruling also hinders property registration in Bengaluru, the state capital.

How to Submit an Online Encumbrance Certificate Application

  • Go to the appropriate sub-office. Registrar’s (jurisdiction depends on the location of the property).
  • Submit duly completed Form 22 .
  • You will need to enter information such as the names of the buyer and seller, the location of the property, and the type of document you are applying for (EC in this example).
  • Pay the correct amount at the counter.
  • If you successfully submit your application, you will receive a referral or approval number. This number can be used to check the status of the application online.

How to Check the Status of an Encumbrance Certificate

  • Each page follows different procedures to check the progress of your EC application. You can check the status of your application on several government websites where you can submit an online Encumbrance Certificate application form.
  • For example, users of the official Kerala government website are able to check the status quo. Following are the steps:
  • Under the “Certificate” menu, select the “Encumbrance Certificate” menu item “EC Status”.
  • Enter the captcha, enter the Transaction ID you provided when you submitted the application, then click “Check Status”. Once the certificate is displayed on the screen, you can download the degree in PDF format.

When Can I Expect to Get an Encumbrance Certificate?
